Terms of Service

1. Service description
SurgOS is a surgical intelligence platform for cataract surgery. It provides structured audit tools, outcome analytics, AI-assisted operative note generation, and clinic management capabilities. The service is accessed via web application and provided on a subscription basis.
2. Intended use
SurgOS is designed for workflow support, surgical audit, analytics, and documentation assistance. It is intended to be used by qualified healthcare professionals and the clinical organisations they work within. By using SurgOS, you confirm that you are accessing the platform in a professional capacity.
3. No medical advice
SurgOS does not provide medical advice and is not a clinical decision support system.
- SurgOS does not replace the professional judgement of a qualified surgeon.
- All AI-generated content is assistive only and must be reviewed by the responsible clinician before use.
- Clinical responsibility for all decisions remains entirely with the surgeon and clinic.
- SurgOS accepts no liability for any clinical outcome arising from use of the service.
4. Accounts and access
You must provide accurate information when creating an account. You are responsible for the security of your credentials and must notify us immediately of any unauthorised access. One account may not be shared between multiple individuals. Organisations are responsible for managing their authorised users, including removing access when a team member leaves.
5. Data responsibility
Clinics remain responsible for the lawfulness of the data entered into the platform. This includes ensuring that any patient references comply with applicable data protection legislation. SurgOS is designed to work with pseudonymised data; clinics should avoid entering direct patient identifiers wherever possible.
6. Subscription and payment
Access to SurgOS requires a paid subscription following the free trial period. Subscriptions are billed monthly. Payment is processed by Stripe. You may cancel at any time; access continues until the end of the billing period. No refunds are issued for partial periods.
7. Free trial
New accounts receive a 14-day free trial with full access to the features of their chosen plan. At the end of the trial, a subscription is required to continue using the service.
8. Availability
SurgOS aims to provide reliable and uninterrupted access to the service. We will notify users of planned maintenance where possible. However, we do not guarantee uninterrupted availability and accept no liability for losses arising from service interruptions.
9. Intellectual property
All software, content, and technology constituting the SurgOS platform is the intellectual property of SurgOS and its licensors. You retain ownership of all audit data you enter into the service. We are granted a limited licence to process that data solely for the purpose of providing the service.
10. Data export
You may export your audit data at any time in CSV format. Upon account termination, data remains available for export for 90 days before permanent deletion.
11. Limitation of liability
To the maximum extent permitted by applicable law, SurgOS shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the service. Our total liability to you shall not exceed the amount paid by you in the three months preceding the event giving rise to the claim.
12. Termination
We may suspend or terminate your account if you breach these Terms. You may close your account at any time by contacting us at legal@surgos.com.
13. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email. Continued use of SurgOS after changes constitutes acceptance of the updated Terms.
